In theory maybe - because the bank can now lend the money at higher interest rates. But the contract surely states something about a prepayment penalty. And why should the bank waive that?

You mean the active/passive method? Just checked our contract, you practically need to have studied for that :) However, the fine print also states that the maximum possible amount for the prepayment penalty is around 47k euros. I had that amount in mind without knowing exactly how it is calculated.
