Hello everyone,
Yesterday and today it unfortunately fully escalated.
After we were informed via WhatsApp by the neighbor on Saturday that actually only the beginning of the excavation was scheduled for yesterday, we learned rather casually yesterday that from today onwards the underpinning would begin without our prior examination and approval/consent.
Accordingly, the mood at the construction pit was heated. Parts of the terrace were simply dug up as a working area - of course without consent. At least the minimum distances to the foundation were still maintained so that nothing would happen there.
The Viebrockhaus did not agree at all since there is a water tank directly on the property boundary.
Annoyingly, we actually would have agreed to the underpinning if we had been given time to review it. Our general contractor referred us to a soil expert and construction supervisor who then arrived on site around 5 p.m. to inspect the work.
However, the neighbor was not willing to include him in the further course of the underpinning process, so the expert would have had four on-site appointments in total. We were also denied access to his property.
The informed police naturally could not help, and so it came as it had to: today we obtained a preliminary injunction at the competent regional court with the ruling that he is now not allowed to do anything on our property, and certainly not perform any underpinning - under threat of a €250,000 fine or six months imprisonment.
Fortunately, the neighbor apparently forgot to schedule an appointment with the surveyor today, otherwise the underpinning would already have started. This was just prevented in time.
