The particular problem here is also the minimum size of these plots. Red, where Goalkeeper has built, above the middle house. If everything is properly coordinated, then as a future neighbor you can be somewhat flexible, but like this ....

For what reason is their measuring frame, that is, their wooden corner, actually standing so far on your property? Or is that just an illusion caused by the perspective? Your downpipe is also nicely exposed and is not supported on the KG pipe, and the studded membrane above the insulation is only there as an alibi. I fear that you will need quite a few discussions before the original condition is properly restored. Or have you already planned to have the reconstruction monitored on your side?

In any case, I wish you that the neighbor comes to their senses and that you can live there peacefully in the future.

Not that you had already given your consent - but had he at least mentioned something like that beforehand? And was your terrace already paved or otherwise developed?

I also find the floor area ratio of 0.4 and the floor space index of 0.5 interesting – how does that work with the middle house?

Nothing was mentioned - the excavator driver just said he needed the space as a working area and bam, it was already gone.

Of course, we haven't done anything in the garden yet, as both neighbors hadn't built yet - except for graveling and putting sand on top and temporary artificial turf for the kids.

He cannot invoke the hammer clause as it happened without the required two-week notice. A report for trespassing would be within the realm of possibility. But your lawyer has surely already checked something like that.
