Just a question: the neighbor has already done his excavation and is about 2.80m deeper – he has also already dug up about one sqm of our terrace.

Since we don’t know when he will build and we don’t want to spend another summer without a garden, we would have L-shaped stones set at 2.80m high so that we can finish the garden.

However, do L-shaped stones that only serve as support and don’t stick out even a cm above count as requiring a permit or not?

To be honest, not really. The neighbor has now submitted his third notification procedure, which I will look at next week at the building authority – for whatever reason he did that.

In the meantime, the preliminary injunction proceedings have also been completed – in total, this has cost the neighbor almost €4500 – wasn’t foreseeable, right? :rolleyes:

Otherwise, the Viebrockhaus is still arguing with the planner of the middle house about the deep foundation. I suspect that there might also be problems here.

In addition, according to the preliminary injunction, all construction work on our property is prohibited for him. However, he will have to do this for his basement construction, roof connection, etc. – but don’t think he has responded even once so far... well... we remain calm and will first have the paving work for the parking spaces done in the next few days... the garden will still take a while.

Thank you for the update. It really is a mystery to me what the neighbor hopes for in the future. Probably not renting out either, right? Moving in myself, going against all financial losses, I really have no desire...

It will work out somehow..

How is the little one doing? A small tip I want to give you is to get the garden ready so that your child can play outside. We did it gradually and now notice the difference, our little one can walk and is allowed to move freely in the garden without us having to worry that she might run into the street or fall down the slope, etc. If I compare that with the older one who was 1 year old back then, oh dear what comfort :-)

I can't finish anything in the garden because the neighbor has dug out two meters of our terrace and then there is about three meters down. We can't refill until he has built the basement. At the moment, there is only the construction fence, which is quite dangerous for the kids. That's why we can only use the garden to a limited extent right now.
