Honestly: from my point of view, the best solution would seriously be if at the head of the property there were three visitor parking spaces and then the green area "Bürgermeister-Dummkopf-Platz". Plan B on my wish list would be for the dim-witted neighbor to build exactly the house he is rightfully allowed to build without risk, then get divorced soon after and in the course of the partition auction the property would fall into the hands of a pleasant fellow.

Normally, according to the GÜ, the foundation should have remained 20-30cm in the "sand".

And our [GÜ] is currently no longer able to carry out the underpinning due to possible warranty claims - understandably.

I can absolutely understand your GÜ and with the current workload, it will surely be more than difficult for your neighbor to find a contractor who will take the risk. I fully agree with you, after the delays it can only be up to you and the advice of your experts. And definitely sign up big with ... for the mayor’s position.

You should, apart from the fact that the cause should pay for it, possibly also "look around" yourself to have someone else carry this out. Would your GÜ possibly do this? Because in that case, the protection of my property would be more important to me at first, so that I would otherwise pay for it myself.

That the GÜ is not eager to do it anymore is understandable. Because knowing the background, I probably wouldn’t work with the neighbor anymore either, even if your GÜ is usually very well disposed towards you. He will also weigh it for himself that trouble could possibly arise there. Once directly and then possibly later, if there should be problems and it should be blamed on the underpinning. The question is of course what you have to allow according to the law? Depending on the federal state and neighbor law, I believe you cannot "prevent" the underpinning.

From my point of view, no. Winter is coming, I would see the time as ripe for an urgent application for an injunction that the neighbor must cover the bare tooth sockets of your foundation again. The colleague "referee in robe" should be asked to send the foul player off the field. I would not refrain from the knockout shot here.
