Wait with the building application because of the child construction allowance

Yesterday, two letters from Bayern LABO arrived at the same time, quite an interesting story. My Baukindergeld Plus was approved, the home ownership allowance was initially not approved because it is not clear that the building permit was granted after 30.06.2018...

Interesting story, 2/3 were approved on the basis, I will call right away.

that is strange. with us, the first payment is already in the account by now, so it was quite fast

If you have more than one child, you can trick the system Sell, gift primarily (this will be free of charge and no property transfer tax will be incurred) Then apply for child benefit for homebuyers and after approval have the apartment gifted back. From two children on, the hassle is worth it

Is that possible? Isn't that fraud or something? But it's probably too late anyway. The decisive date is, as far as I know, the notary appointment. This matter still doesn't let me rest. From the KFW information sheet: "Provided your household (applicant as well as spouse or partner in a marriage-like community or children) already owns a self-used, rented, usufructed, gratuitously transferred, or vacant residential property in Germany for permanent use, a subsidy with the Baukindergeld is not possible." I don't think the student flat meets this definition. Edit: Now that I read my own quote again, I realized that the children must also not own any property. Others had already thought of that.

Well, well ... then one should definitely deal with gift tax ... Parent to child is actually more of a one-way system . And rightly so, because such back-and-forth tricks are meant to be avoided.

From when is a property actually considered a property?

We acquired a condominium from a general contractor for rental purposes a year ago, which is currently still being built. The shell construction has just been completed, and completion for occupancy is planned for March next year.

In the meantime, we have purchased a plot of land on which the construction of our owner-occupied single-family house will soon begin.
