Wait with the building application because of the child construction allowance

At the moment, nothing is fixed and everything is only vague. Therefore, one can only speculate. Nevertheless, I would be interested to know if we would be entitled at "some point"?

Currently, we have no children, but they are planned in the next 1-3 years.
The construction financing has already been completed (beginning of February). The contract for the house will be signed soon. Construction will begin in autumn, and moving in is likely in spring 2019.

If everything goes as we wish, we hope for offspring in summer/autumn 2019.
Do I understand correctly that we would then still be entitled to 8.5 years of Baukindergeld?

So financing in February 2018
Offspring in autumn 2019
That means an 18-month period in between, so still 8.5 years entitlement.

Or does the time of moving in count?

As I said, nothing is fixed yet. I would just like to know if I am interpreting the calculation or the entitlement correctly...

There isn’t even a public draft of the legal text yet. You can only make statements based on guesswork for specific examples.

But the day the ink hits a contract is probably decisive.



However, I would rather guess that you end up empty-handed. If it turns out otherwise, then you can be happy.

The coalition agreement contains the following 3 points, and for all 3 I do not see anything being possible retroactively or proportionally:

I know that nothing has been signed and I have mentioned that as well. So far, there are only reports on news portals that refer to it. Whether the sources are trustworthy is another matter.

But I suspect, like you do, that we probably will not have any claim to it.
I think, if the law is passed, only people who take out a construction loan AFTER the law’s decision and have/will have children will be eligible.
Everyone who has already taken out a construction loan beforehand will probably come up empty-handed.

But hope dies last.

If the following hypotheses are pursued:

- Baukindergeld will not be paid retroactively (so only possible from the cut-off date of the law's enactment)
- The basis for the cut-off date is the same as for the Eigenheimzulage (i.e., date of signature for the house purchase or date of submission of the planning application to the building authority or approval of the planning application)

Then I hope (for myself & others) that the law's enactment will come before the summer break. Otherwise, it means waiting or swallowing the bitter pill.

Unfortunately, I still have no idea how to deal with this with 2 children if it takes 2-3 months longer :-(

That would be before 07/06/2018 (the last day of the last session week before the summer break). It continues then on 09/10.

Bit by bit, a date is being attached to the Baukindergeld. It should be implemented within the 100-day deadline. See [Tagesschau]
