From the KFW information sheet: "If your household (applicants as well as spouses or life partners or partners from a marriage-like community or children) already owns a self-used, rented, usufructuary-used, freely provided or vacant residential property in Germany for permanent use, then funding with the Baukindergeld is not possible." I don't think the student apartment meets this definition. Edit: Now that I read my own quote again, I realized that the children also must not own any property. Others had already come up with this idea.

Completely legal. The notary appointment for apartment sale/gift must be one day before the notary appointment/building application.
