I am also AE, but to be honest, I can't really understand your child's registration situation ... Or do you have a 50:50 model?

My daughter is of course registered with me, and we have not registered a second residence with the father for her (why would we?)

However, we also more or less live according to the "classic" model ...

If after a separation the shared apartment is kept, then the children remain registered there as well, a change requires the consent of both parents, at least with joint custody. I moved out because we lived in his house, which belongs only to him. And he did not agree to a change of the main residence. Therefore, the main residence of the children is with him, but he agreed to the registration of a secondary residence.

According to registration law, the main residence should be where the children mostly stay, which would indeed be with me. However, this can only be enforced legally, according to the local registration office, but I am reluctant to take this path – we still have to take care of the children together in the future. So far, it has not played any role in practical matters. We care for them about 4:3, so almost half and half.

For example, a friend did not receive housing benefit because the child’s main residence was not with her. Better to take care of it early before the legal enforcement outlasts the application period for the Baukindergeld.
