Simply through your ventilation behavior, you can completely negate the advantage of 40 over 55 if the windows are often open or tilted despite the ventilation system. It is a matter of habit.

Did I miss something? New construction funding? Sounds like a relic from a long past era…
From an economic perspective, the (energetic) renovation of existing buildings is more important than making new constructions even more efficient (in the last 10% of efficiency). In this respect, yes, people can find it annoying, I understand if there is discontent, but from the government's perspective, it makes sense.
That should exactly be the way. Not optimizing the last 5% in new constructions. Better to save 50-70% in existing buildings. In some houses, they still use oil... A new building cannot save that much gas/electricity in 5 years. New construction simply KFW70/Energy Saving Ordinance or for all I care KFW55 without subsidies. Additionally, heat pumps mandatory except for special justifications. Make photovoltaics profitable through extra subsidies (as is already the case). Always demanding and subsidizing stricter standards in new constructions is a wrong path when looking at the existing building stock in Germany. But something is supposed to come from the new government.
