I hope so, but I don't think they will change their current plans without pressure.

I first contacted the consumer advice center in Bavaria to get initial feedback before speaking with a lawyer.

No, but also not burning money. From my kids I got a nice explanation (probably from the internet) from school:
"The article also says: Property is an obligation. Property should be used in a way that benefits everyone. This means, for example: Whoever owns a factory should offer jobs to people. They should pay them well. Whoever owns many houses should rent out apartments. Then other people can live there. Whoever has a lot of money must also pay taxes. With the money from taxes, the state can then do something for all people."

He should rent out apartments. Yes, he should. But he is not obligated to throw his money out the window to rent them out. And it does not benefit everyone if a lot of money is spent on renovations and the tenant can then have 23 degrees in the apartment instead of 20, while at the same time enjoying nice fresh air through the tilted window. And that even with the same rent and maybe lower heating costs.
