Do you have more information on where this requirement is stated? Is this clause really included in all contracts? I find that hard to believe, because as a general contractor you actually don't want this clause for planning purposes.It was a requirement of the "[B]BMWK" to include this clause in contracts so that the project's eligibility for funding is maintained even if the contract is concluded BEFORE the application is submitted.[/B]

Contracts concluded before the application date for consulting and planning services do not count as project start. However, the conclusion of supply and service contracts for the construction services to be funded before the application date constitutes the start of the project and generally precludes funding.
In grant law, it is recognized that a suspensive or resolutory condition in supply and service contracts can prevent the occurrence of a funding-precluding project start in relation to the granting of funding.
I think back then it was also hard to imagine that the clause would ever be applied. The classic black swan indeedI can hardly imagine that, because as a general contractor you actually don't want this passage, for the sake of planning.
