I would talk to the GU, my goal would be to remove the clause by mutual agreement and leave the contract unaffected and proceed with construction. Or Whoever depends on the [Förderung] may possibly have a cheaper exit to limit the damage.

I don't think that would be legally secure. You would essentially be modifying a contract that has already expired/invalid/does not exist. I would definitely consult a lawyer beforehand ;)

You are absolutely right there, we were incredibly naive! As I said, when signing, we had about a thousand things on our mind, but a) never that this subsidy no longer exists and b) that the house provider can/wants to get out of it again.

Today we read the condition with completely different eyes and it hits you in the face right at the first reading.

That is exactly what we are currently aiming for. Contact has already been made and I don’t want to rule it out either; they sound very cooperative on the other side (which, on the other hand, we cannot quite understand, which is why we somehow don’t entirely trust the whole thing).

Please have the whole thing checked by a lawyer. Don't let there be trouble halfway through and then it turns out that the entire contract is actually invalid...

You have to be very careful if you want to take a new or different KfW subsidy. And again, it very much depends on the exact wording. The mentioned FAQ with point 3.11 even has two templates:

Since the subsidy can still be applied for from April, a contract based on these wordings can be continued.

There are three conditions in the template:
- Application within x days
- Suspension until the approval notice
- Termination upon rejection notice
