Today the statement regarding the questionable expert report has been received.

Regarding the statements of Mr. XXX, we respond as follows.
-Sealing: The base sealing was carried out according to the generally accepted rules of technology (a photo is enclosed herewith).
Likewise, the horizontal sealing at the joint to the horizontal building paper was carried out (a photo is enclosed herewith).
The base will be repaired/correctly executed accordingly in the course of exterior plaster work and sealed again.
-Masonry: The damage and holes in the masonry will be repaired accordingly; however, this does not constitute a defect,
but rather shows work not yet completed. Accordingly, these areas will be covered with mesh during the interior plaster work.
The spalling on the precast concrete elements is likewise being addressed.
We fully reject the other points according to the expert report, as these points do not constitute defects and the tolerance/DIN
has been complied with.
Cracks have a crack limitation up to 4mm, which does not occur at the specified point, as they measure 1 mm,
thus this crack is harmless and complies with the standard.
Furthermore, there is no moisture problem; rather, this residual moisture results from the cellar drying too slowly,
since the roof was only recently completed and thus no water can penetrate anymore. This moisture is unavoidable without the execution of the roofing.
Photo 23 shows no fastening; however, a close look and a proper inspection would reveal that this fastening has been carried out (a photo of the executed fastening is enclosed herewith).
Likewise, when conducting the inspection, one should look closely to get an overall impression of the entire construction site,
since the solar system was indeed installed on Monday, 11.06.2018, as you pointed out to me after discussing the rough installations that it was located on the upper floor. It was mounted directly on Friday, 08.06.2018; this can gladly be confirmed again by Mr. XXX and the employees of the company XXX.
Also, photographing formwork being dismantled onsite by workers represents an unfinished service not subject to evaluation.
DIN 1801 relates to interior doors. It cannot be applied to the mentioned point concerning terrace/balcony doors.
The dimensional tolerances in the masonry are known in the house and will be repaired during the exterior plaster work.
The further statements of Mr. XXX are assumptions and speculations, which are proven by nothing.
The new expert will come on 2.7.
He says that presumably quite a few things indeed do not fit, as stated by the first expert. But he says that regarding insulation, he sees indeed a need for action.
Let's wait and see.
