I don’t understand that either! Reason given by the general contractor - different designs of the slats! That’s his problem, not mine!!! If he offers the slats with given heights from the building application, he has to deliver accordingly or at least say beforehand that this or that slat only works with different heights.

On the one hand, I also think so, on the other hand, it's nicer when it "fits" than when he implements it with four point one slats, because four are too few and five too many. Maybe he thought you wouldn't understand anyway (since you thought the gate would be rolled up as a coil)?

It's quite simple. If he offers the slat XY and explicitly writes "based on the building application", then he has to deliver it that way or say in advance that it doesn't fit. If he then simply changes the dimensions compared to the building application and afterwards basically says: "You wanted this slat, good man.", then that's not okay and I don't think even as a legal layman he will get away with it.



The point in contract work law is not what expert knowledge either party has, but simply what has been contractually agreed.

That’s true, but one client prefers the agreed height while the other jumps up and down because of it – what in my opinion looks like sh*t – if there's an extra eighth-something leftover strip added at the top or bottom instead of rounding it to whole panel elements.

I agree with you. Ergo, it would have made sense to discuss this with the client as a construction company.

As I see it, without clarifying anything, he would legally be better off now with the cut slat.

I can’t understand how anyone can work like that. Whether as a general contractor, a freelance architect, or whatever. You clarify such things with the client. Or rather, he didn’t even have to clarify anything but simply had to write the correct measurements in the building application. Then even we would have noticed that it doesn’t fit.

Tastes are so different: I would never ever come up with the idea for such a special complication nonsense to panel the rear gate differently than the front gate. As many finite elements as possible, complexity reduction. Every additional corner is also one where more things can go wrong.
