And congratulations on the completion or the light at the end of the tunnel.

But I want to give you one more thing to take with you. Even if it is your goal to enforce it. Stop complaining, for the sake of your health.

I know of 2 cases from the neighboring forum where the process has been going on for 10 years..
Dozens of expert witnesses, judges, deceased lawyers, etc.

But in your case, it is health that speaks against it.

By the way, a reform of the legal system would be necessary. Payment of lawyers only after the conclusion of the legal dispute, for example. :p:p

Oh, the boys are manageable. The little daughter is much more exhausting. And also the reason why moving into the new house is not up for discussion. We get along quite well, but certainly not under one roof.

On the topic of lawsuits. Thank you really for your sympathy. But I would have to be turned inside out for that. I would advise anyone else against doing what I do, also because I know that it can be a kind of self-destruction in financial and health terms. But I have to do it anyway. This does not only concern the construction. I sued to get my job back, where many/all thought that it was impossible and that if at all, I wouldn’t be able to endure it. I was very sick during this time, but precisely because I couldn’t come to terms with this injustice of arbitrary dismissal. From the day of the verdict, everything was fine again. My good old Mercedes Vito, into which a left-turning driver crashed 2.5 years ago, and which the opposing insurance declared a total economic loss (value lowered to €3,400, repair costs over €11,000), based on a low replacement value but incorrectly, i.e. significantly lower equipment features and worse condition. For example, only 5 seats instead of the existing 7, the glass roof declared cracked even though only the protective film was torn, vehicles without a trailer hitch, automatic transmission, green emissions sticker, and with expired inspection, and partly with mileage beyond 400,000 km were used as comparison vehicles. We pointed this out to the opposing insurance several times and also commissioned a counter-expert opinion. But they stuck to their position. I sued against this. The court ordered an expert opinion by an expert appointed by the court, advance payment costs €3,000. He then did find the 7 seats and the uncracked glass roof as well as a better condition than in the insurance’s report. And now the joke: since he could not find any comparison vehicles matching the criteria of our vehicle in his research (vehicles with Westfalia equipment are very sought after despite their age), he agrees with the opposing expert’s opinion on the replacement value and this "seems" justified to him. Our expert opinion remained unmentioned. I simply cannot accept something like that. So I raised objections to this expert opinion and asked for a review. Result: Court order for a supplementary expert opinion with advance payment costs for me over €1,500. I do not expect the expert to revise his opinion. But I cannot accept this and simply have to take action against it. Otherwise, I wouldn’t be able to come to terms with myself. But as I said, I would advise anyone else against this course of action.

The minus 3400€ is what you are disputing. The rest is feelings.

In the end, isn't that a loss-making deal?

At the moment, it is not only a loss but madness. The vehicle was worth about 8,000. However, we want to keep the vehicle and have it repaired. There is nothing comparable on the market. Besides, our vehicles belong to the family;).

Honestly, what you and some others here call a 'sense of justice' is obviously a pathological personality disorder. It's ALWAYS someone else's fault, it's ALWAYS your standpoint that is right. House, car, job, the list can certainly be continued indefinitely. The fact that you constantly put yourself on the sidelines and under massive pressure because of this and that even very serious physical impairments do not make you reconsider says a lot. I hope that the whole thing somehow turns out well for you. For you, the soon-to-be-finished houses may seem like a victory, but unfortunately they are a Pyrrhic victory. The real battle takes place within you.
