The question is what it will cost you in the end, and I don't mean money. But well, that's up to you to decide.

Now an informative question:
If at some point GU3/construction company three takes over the lawyer. Who then pays them? Is there a realistic way that someone will pay for that for you?

Apart from the fact that the word “lump-sum contract” does not guarantee a move-in ready house, it is relatively simple to explain and has nothing to do with being scammed. Do you know the scammers on classified ads who offer you a new iPhone for 400€ and then disappear with the money after the transfer and you don’t get the phone? Although everyone knows that you can’t get a new iPhone for -50% of the price, hundreds of victims still fall for it.

Well, and it happened to you on a “larger” scale. You ended up with someone who probably never planned to build you exactly the house according to the construction specification, because it is simply impossible from a calculation standpoint. You never questioned the too low price until it was too late.

We worked with an architect and individual tradesmen of regional craftsmen with a very good reputation, where the trades have been working together for years and have even attended school together in some cases. The construction coordination was carried out by a private construction coordinator. We were at the construction site twice every day and made decisions on a daily basis.

The house with cellar was ready to move into after just under 9 months.

Time and nerves, but I have gotten used to that by now.

This is not the lawyer's construction company, but a company known to him, and I really don't believe he would recommend a company he is not convinced of. Because if disputes were to arise here again, he may not represent this company against me, as I am his client, a so-called conflict of interest. Besides, nothing has been decided yet; there are other alternatives as well.

That is your/your group's opinion that it is impossible. I, along with several others (expert witnesses, lawyers, construction managers), see it differently. And your comparison is flawed. The alleged seller is anonymous and therefore can hardly be held accountable.

GU2 must remedy its defects. Either through its SUBs (if he can still get hold of them) or he must cover the costs himself. He is legally obligated to do so and cannot avoid it. Since he caused many problems himself and there are no real contracts with the SUBs, he will probably go bankrupt afterward and will no longer be able to complete the work. Then, first of all, his performance bond will be due. I still have enough money myself for continuing the construction. So that would not be a problem. It is important to determine the exact amount of the defect correction costs.

That is exactly your problem, you want to listen to people you pay. We are a construction forum here and without exception everyone has told you that it is not possible. Unfortunately, you keep getting the bill for exactly that unreflective behavior. We have all built and know the prices. My architect calculated 400€ pure construction costs per cbm including exterior shell and ceilings 3 years ago.
