He himself provided the evidence of poor performance, which I have in writing. To collect his claim, he filed an enforcement application as well as a payment order at 2 different courts simultaneously. This is not exactly common and did not make a good impression at the court. He was unable to enforce either of them. He had to withdraw the enforcement application.
So it is not even out of the question that I myself will not lose the first case. However, I could/would not sue him because then I would have had to pay the court costs for the high value in dispute, so we hoped and waited for him to do so.
December will be extremely exciting. My daughter's move-in, court hearing 1 as defendant against former lawyer, and court hearing 2 as witness in the trial for serious bodily injury of my first general contractor. Who even does something like that? I am already looking forward to seeing him again.

I have received a summons to testify as a witness in a court hearing where a SUB of the 1st GU is accused of serious bodily injury to his client, that is, my 1st GU. Better like this?

Can't you make some kind of construction botch show out of the whole thing? You certainly have enough material...

Actually, I wanted to hold back a bit, but I would still like to accept your offer. But your counterclaim has a dispute value of over €100,000. That means the subject-matter jurisdiction lies with the regional court with the corresponding mandatory lawyer requirement, etc. So either you will be forwarded, or your counterclaim will be rejected. Paragraph §506 ZPO would be interesting here. Or am I completely wrong?

I think, someday I'll write a book about it. Television won't come into my house (Not that they might find the bodies I have cemented in my basement.)
