With Mr. Th. it is also difficult to quantify the claims for damages, here the very expensive expert report should provide statements about which errors are construction supervision errors.
Your lawyer comes from industry and large projects. Construction supervision is elemental there. He has to approve things strictly, or not at all. Otherwise, the following trades might not be able to work and lawyer letters go out immediately if something is wrong or even just one day delayed. (I once was told that craftsmen get warned even if they are delayed through no fault of their own.) But on a private small construction site like you have, there is no construction supervision as your lawyer is used to. As a private person you also only commission a construction supervisor, a construction consultant, or similarly vague job titles. Occasionally someone comes by, looks a bit here and there where something can be seen right now, and points out visible defects they find. That’s it. It’s only supposed to give the builder a good feeling. If something is faulty, they still continue building, because the consultant has no authority over the general contractors or craftsmen in any way. They also don’t warn the craftsmen; that is your responsibility as the builder. At least that’s what many people commission. Which of the two options (construction supervision or construction consultant) did you commission?
He was invited to the date of the roof expert report and the reason given for cancellation was that he has been so seriously ill since July that he can no longer move around independently. That may be true, but it could also be an excuse. If it is true, then the house is probably cursed, because almost everyone involved with it goes down the drain. At least that’s my feeling.
Also a crazy thing. For your collection, you still need a contaminant report if everyone is getting sick ;)
