You certainly received a cost estimate, right? How did you commission it, verbally? According to German law, everything I commission I have to pay for. Obviously, a job based on proof, i.e. labor hours, was agreed here. Accordingly, the contractor is entitled to full payment from the point at which he starts working for you on site. If he procures or loads materials, that also has to be paid for, as well as travel costs plus vehicle kilometers (probably included in the materials list). The calculation ends when he parks the vehicle at the company and no further services related to your order are performed. Break times are of course deducted.
What I noticed in an earlier post is the following. You said the ground had to be replaced because it was not compactable. Later you said he removed too much, then you said he excavated too extensively. And then he also installed the wrong soil and construction debris? Which is it? That’s really too much confusion for me. First, you complain that the new construction company installed a site door without a key and today that you removed the site door. What do you actually want? That does not fit together either. You obviously don’t want to pay the new construction company either and complain when they make use of their retention of title?
Zaba12 seems to be a smart calculator. He obviously knows the property as he generally gives a much cheaper assessment. Maybe he is the right partner for you? With him you can save!!! He knows what’s going on.
By the way, now everyone who knows the name of the construction company knows who your BU is. Getting the name and workplace of the lady was not difficult. I know now! I hope the BU has not read this.
So, as I said, it is certainly not all as you portray it. Defects occur on every construction site and no contractor lets that be said of them. If one had worked with proper tact, perhaps it would not have come to this. And having stress with two construction companies one after the other also indicates to me mistakes in dealing with the construction companies.
In our construction company, there are also sometimes disagreements with the customer. But we always clear them up in joint discussion. For several years we have had very good reviews and satisfied regular customers. That doesn’t come from nowhere.
