Then you should read again that the contractor has not paid anything so far, but the OP will soon have an enforceable title in the five-figure range in hand.
Currently, the procedure is at the stage where nothing has to be paid yet, but construction should continue. Since the contractor is now failing to do this, it’s going to the money.

If we obtain an enforceable title, it will even be in the six-figure range. We have submitted a concrete offer with additional costs for the continuation of construction and the remedy of defects in the amount of approximately €140,000 to the court. These would have to be paid to us in advance by the BU. But no one probably believes in that.

so the business is potentially dead, given the background. I'm keeping my fingers crossed that you all can still endure the process (financially) and, above all, manage to finish building the house. Injecting another six-figure sum is really not possible for everyone.

I also think that he is drawing the line here. He will never pay that. On top of that, since December 1st, the contractual penalty is running, almost 1000 € per week. But he has maneuvered himself into this. In the end, we will sue him for fraudulent settlement, let’s see. If nothing else comes, we have the retention for the unfinished roof structure and the numerous defects and the guarantee, totaling about 60,000 €, but that will surely also be used up for defect repair. At the end of the year, we had the surveyor come again (not exactly cheap either) and are now waiting for the result. The fact is, there are serious defects, even the static requirements have not been met. Concrete supports are missing or are not where they should be, steel beams are not supported, the load-bearing capacity of the roof structure is not guaranteed because the ring beam and the bracing supports are missing, the knee wall supports have insufficient concrete cover as well as cracks and concrete notches, etc.....
