Forget the nonsense about selling. That would be a total loss of the building costs. The 130k€ are not currently lost, they are tied up in the property. A part is overpaid, yes, that is the damage plus maybe 10k€ to fix the mess.
Waiting until the trial, possibly insolvency and lawyer fees only increase the loss. It can happen. Look for architects and continue building. Beforehand, discuss this goal with a lawyer and establish legal certainty (prepare/execute extraordinary termination, etc.). Claims for recourse are then a minor issue that can be pursued or not.
Wait! When the OP said 130k, did she also mean an assumed total loss of the construction site?
Because the construction site obviously still has a value. (At least I still assume so!).
Then the worst case would be well below 130k. In that case, I would personally do everything to cleanly settle the matter with the current general contractor and then resume construction as quickly as possible!
@OP: Please don’t forget that 99% of construction errors can also be corrected. Especially if you are still in a relatively early construction phase!!! It often looks worse than it actually is!
