Back to the topic: The expert report is here. We already knew the defects. Now we have them in writing. It is crazy how much a stamp on the paper costs!

There have been new developments just now: Mr. BU sold his company as of 31.12.2019 and stepped down as managing director. The new company is called Ciesielski & Krol Bauunternehmung GmbH. I cannot yet say what this means for us. According to my advisors, it is not worse for us than before; either he sold an insolvent company, for which he can be held liable, or the company is solvent and we can assert our claims against it. That is the theory.

If he has sold an insolvent company, we can hold him liable under private law. And I know that he has a nice little house on the outskirts of Leipzig and no separation of property. The question, however, is how many claims we have against him and at what point we come in, because we will probably not be the only ones. What surprises me again, though, is that one can sell a company here in this country against which at least 2 legal proceedings are currently ongoing.

Why should one not be allowed to sell with open proceedings? And he would only be insolvent if there are claims that cannot be serviced. Ongoing proceedings do not trigger insolvency, do they? Does his successor know about the fun? Ea remains exciting.

Remove the name. This makes it very easy to identify all parties involved.
