You are emotional. That is understandable. You wanted to build a house and now justice is your primary goal? Draw a line as soon as you are reasonably sure about the insolvency. Objectivity and pragmatism will protect you from further mistakes.

As sorry as I am, you will see very little money here - if any at all. From the way you write, it will likely end in the insolvency of the construction company. I strongly assume (make sure you get information on this) that there will be other creditors. Therefore, if at all, you will receive a rank position in an insolvency estate. And what can come out of that is ridiculous.

It seems important to me to push the construction forward. Are there other family members who might be willing to provide a private loan? Getting money in is probably extremely important right now.

So it seems cheaper for him to let it come to a head than to finish the construction, and he may no longer have hoped for your willingness to negotiate. Was there an attempt at mediation? Would that still be an option?

Thank you. I am basically very emotional. I could cry if I lose a 10€ bill and here it’s about 130,000 €. My God, what kind of cars could you buy for that. I will probably never be able to look at this objectively, not in 100 years.

I can understand that well. But separate yourself as much as possible from your primary goal. That is about as likely as a trip to the moon. Sorry. You have to think about yourself and your family and thus about your future. Otherwise, in the end, you will have personal bankruptcy and a laughing gentleman, because "only" the GmbH suffers (insolvency) and nothing happens to him personally. It’s tough, but it cannot be changed. Your energy is better invested in the house construction and your family than in the contractor.

As mentioned, both lawyers have been working on a settlement for over 3 months, with recurring points where opinions differ. We then always respond within 1 - 2 days, and he sometimes takes up to 4 weeks.
