Construction company halts work despite overpayment

Rather the opposite, since the aforementioned company, or rather their subcontractor, built the basement 10 cm too far out, additional expenses for the outdoor facilities will arise. Yes, it is a GmbH with a liability of €25,000, and we will probably not be the only ones with claims. Shitty situation is unfortunately the right term. I can't sleep at night anymore. What really makes me angry, besides all this mess, is the fact that neither the lawyer nor my construction consultant, who has been involved since December, made us aware that since the new regulation on construction as of 1.1.2018, the construction company is required to provide a 5% performance bond, otherwise the client can withhold that amount from the progress payments until the bond is provided. Unfortunately, I only found this out now. That would have been a means to compel them to continue working. Instead, I was supposed to pay another €10,000 as a "sign of my good will" for disputed matters, which I did not do. Since the completion according to the contract should have taken place on June 10, 2018, the construction company is currently 9 weeks in delay. There is also a provision in the contract stating that a penalty of €900 per week would be due, but of course, they are not paying that either.
