The employer only grants the long lunch break, he does not have to pay for it. Biting into the sandwich in between is – similar to a small window opening when laying bricks or plastering – "measured extra," and travel times are also working hours for the passenger/co-passengers, which are paid; as well as setup times. While worker A and B are still loading (setup time, paid), worker C can already sit in the car, but is practically forced to pause because A and B are still loading and driver A has not yet gotten in. He does not need to bring forward his contractual break to this time; his idle time is on-call time (paid). So there are indeed times that are practically breaks and of course are not paid as breaks, but the "continued payment" of worker C during this idle time is included in his hourly wage. In Germany. At most, you can fool workers from useless German countries who don't know where the union guy gets the juice from.

Here quite specifically January 28th: 5 people arrived at the construction site at 9:53 AM and left again at 1:28 PM. In between, I delivered coffee and tea, later it rained and hailed for at least 15 minutes, so that no outdoor work was possible. I was still on site at that time because I was waiting for someone. Deducting 30 minutes of coffee and smoking breaks as well as 15 minutes of storm-enforced pause during which one employee packed up equipment while the other 4 smoked and waited, the working time at the construction site amounted to 2 hours and 50 minutes. However, I am being charged for 5 hours and 30 minutes. And all that times 5. This is the boss’s explanation: according to our records, the colleagues left the company premises around 8:24 AM and were not there again until 2:03 PM. Preparation early also includes the construction site allocation and explanation of the work in the company, as well as material procurement. Break times were not counted, our calculation ends at 1:30 PM at your construction site!!!

How far away is the company? Of course, you have to pay for setup time, preparation, procurement of materials, and travel time.

I see it the same way. This is not a private pleasure. The only private pleasure is moving from the bed to the office and the break. I’m rather surprised that five of them show up.
