If defects are known, they must be disclosed, otherwise it will be expensive for the seller.
I did not mean that one gives up all rights with it, but that one can avoid nasty surprises with such properties in advance through good experts. It is no fun to sit in a ruin and sue the previous owner when they are dead or in a nursing home. Junk may potentially hide many defects.
