Yeah, no, in my version I would put it next to it, because I wouldn’t move the house forward but rather backward anyway. Although with the transverse orientation it doesn't really make much difference. It's just the two meters. The hedge also takes up some space. With the 3m strip maybe you really can't do anything anymore. With a 5m strip maybe still a greenhouse? Although that wouldn’t get any light with the 2m hedge either, right? hmm Oh, about the justification: From the agent/builder: So that the building permit goes through smoothly. Why Berlin wants that: no idea... But I can see on Google Maps that the direct neighbor, even with a solid building, definitely doesn't keep 5m, would still need to check if something is possible because of that. It’s not an old building.

Mmh, so maybe the exact development plan including neighboring buildings would be needed here to explore all options. Escroda could certainly help more with that.

As I said, there is no development plan, only up to the other side of the street. However, that one is strict. Not even the exceedances for the terrace and parking space are included in the floor area ratio. There is an ongoing development plan procedure for the area including the property, but it only concerns retail... And how do we get in here? *wink*

And where do the floor area ratio, plot ratio, building boundaries, parking space exclusion outside buildable area, and height restriction come from then?
Well, Berlin is very special, since there is a legally disputed plan there that is kind of an intermediate between a land use plan and a development plan. But without clarity about planning law, in my opinion, no location discussion is worthwhile.

What is also unclear to me: Who actually pays for the path to the backyard now? And who pays for the land? Actually, it should be allocated 100% to the backyard. What is the front house supposed to do with it? It has no benefit from it at all.

I can only speak from my personal feeling about living: Behind the house, I am away from the street, feeling protected in a private niche. In front of the house, I notice much more of what is happening on the street, including traffic noise. If I have a private conversation behind the house, maybe the immediate neighbors can hear it, but not every stranger passerby walking on the sidewalk at the same time. To what extent the area is visible depends on where and how high the neighboring buildings are and whether you have a fence or a hedge. A hedge also takes a long time to grow so high and dense that it provides proper privacy. Additionally, your plot orientation is actually perfect for making a terrace at the back where you can enjoy the morning sun (and in midsummer the shade from afternoon until evening) and a southwest terrace for the sun from noon until evening.
