Good morning everyone!

Actually, I wanted to get back to you only when our building application is approved...

Unfortunately, it is currently delayed. We received a letter from the building authority because we did not name a representative in the application. We did not know that this is mandatory. According to the wording of the legal regulation, this is a "may" provision, right? And why does a representative have to be named at all? My wife and I are the builders. Does one of us now have to be explicitly appointed as the representative?

And the oak is doing great. We are even allowed to get a little closer...

I will submit new floor plans later.

That sounds great.
Yes, a representative is a must. Ideally your architect. I wouldn’t get worked up about it, much bigger problems are coming your way. Just stay cool.

PS: My oak has to be moved now. Too close to the driveway. These oaks, always! Well, 1 meter tall... :P

I assume you are referring to §53 (3) Building Code NRW. That actually only applies if there are several builders with different addresses in the building application and therefore the building authority does not know to whom it should send the notices. Or in the case of companies, to ensure that only authorized persons can make decisions and that only they receive notifications of the authority’s decisions. Call the caseworker to see if that is really the problem. Is that so? For spouses? I don't think so. But I am not yet very familiar with the new building code. You can do that, but I wouldn’t. If the architect makes a mistake with the authority, as the builder you wouldn't even notice at first because all the correspondence goes through them, and they can simply pass their fault onto others.

Oh, maybe I confused that and he meant something completely different. For the building application, we needed a confirmation from a "representative" who is an expert - for us, the architect - so that the building authority knows we are not just making things up and building rubbish. Without his stamp, they didn’t even look at the documents. I thought that was what it was about.

Oh, you mean the building submission authorization. I certainly hope he didn’t submit his building application without specifying a building submission authorized person.
