The fact that the construction is partially moving into the "cold" season is not concrete damage? We actually wanted to prevent that at all costs. "At all costs" in the truest sense, because we of course accepted higher prices for the contracts with the companies...

What is causing the delay, the municipal utilities or their civil engineers?

If it is their civil engineers, as the client I would suggest having your civil engineer, who is already on site, dig the trench for the relocation on your property. Where does the line need to be laid, on your property or on public land? I am not familiar with the local conditions. On our property, there was also a (originally known) high-voltage line. The utility company was visibly happy that our civil engineer dug the trench for the installation. Perhaps the lesser evil for all parties involved.

I can confirm that as well. Civil engineering work in public spaces is scarce at the moment. Nevertheless, I wouldn’t let it come down to a lawsuit. You generally won’t be able to claim anything flat-rate. Likewise, I wouldn’t claim anything on the grounds that the contract was €1000 more expensive because they came a month earlier. It’s more about the ongoing costs. Construction electricity, scaffolding, crane, various equipment, construction fence, portable toilet, container. Something along those lines. You have your exact costs week by week and I would list them and hope for goodwill from the municipal utilities. If there are discussions about the amount, you can always mention the argument about the early contract execution. But hardly anyone will follow that in the end if you try to calculate all that. It’s not nice for you - understandable, but it’s a good example that even a planned buffer can quickly disappear. You can’t factor something like this in.

The civil engineering company commissioned by the municipal utilities could not act at short notice. Maybe we can make a deal that they excavate our construction pit as compensation...
