That is a problem: Not everything that is allowed is also legitimate in dealing with each other. Relying on that only helps in court – where one really should not want to go.The solution would be a compromise. You can't expect him to give up his music 100% as long as it's at times when he is allowed to listen to music. Neighborhood means compromises and not just enforcing his own wishes.
Headphones are not a compromise in my opinion. A compromise would be, for example, that he only listens to music at certain times/hours and otherwise you have your peace. Personally, I find headphones disturbing/uncomfortable. I also like listening to music, but if a neighbor comes to me and complains, I would apologize and turn it off or try to find a compromise, many people are simply selfish and therefore don't care.
Some people find headphones disturbing, others find being constantly subjected to sound disturbing. Whose problem is it then? Such and similar trivialities are dealt with by German district courts every minute. But what for? Even if you win the case, in the end you still have the fuss and noise with the disturbed neighborly relationship as long as you live there. Basically, you can only flee from it.I personally find headphones disturbing/unpleasant.
