Hello There are news again. Our neighbor is selling. When we were at the construction site today, we met the new potential buyers. I don't think they know that he built beyond the allowed limits. Which doesn't interest us either, since we will not make any demands of the future neighbors. My husband just mentioned on the highway that he finds it unfair on the part of the current neighbor. Never ending Story.....

what does he find unfair? that he is selling or that he has built illegally?

there are 2 options a- address him and he doesn’t sell b- don’t address him he sells and you live with it

Well, those aren't the worst news. The new neighbors can't be much worse, and you can also get lucky sometimes, right?

I'm sorry for your neighbor. Surely he and his family have already looked forward to the new home. Hopefully, he won't suffer too great financial losses.

For you, it is a new chance for neighbors with whom everything might be a bit less problematic. I keep my fingers crossed that you get really nice people with whom you get along well and that a pleasant neighborhood develops ... no hotheads.

But they should know that he knows. If I were you, I would have them pay the notary fees for the contract in which you waive the encroachment rent for 99 years. That way, at least other future owners won’t get the idea that the stolen part of your property belongs to the neighbors. Highway? – what might have been written there before autocorrect?

I would definitely mention that before [Gewohnheitsrecht] ever applies
