Sorry, does everything have to be regulated by law? Even your own common sense?
Everyone should mind their own business as best as they can. But to only wait for legal rules, where is the personal insight into the situation there?
Regarding your questions:

I don’t understand. As far as I know, legally the date of approval counts, nothing else.
There is not much time left to understand the world.

So far. However, the current draft of the Building Energy Act targets the time of actual installation or the time when the setup begins. Accordingly, it would first be irrelevant when something was approved.
It is questionable whether this will actually remain the case, how it will be implemented, and what happens with building permits...
If necessary, just start setting up the system promptly.

What counts as "start":
- the installation of the gas fireplace?
- the assembly of the gas heating system
- or only the inspection by the chimney sweep?
I have exactly the same problem as the original poster: construction start with us: mid-May.

Ambitious. It will easily take 4 or 5 months before the heating can be installed. Then it will be mid-October. And I just claim that the decisive factor is not the installation, but the commissioning.

With bad luck, you'll be standing there in January 2024 and the installer will say: "Sorry, I am not allowed to commission it."

Maybe a heat pump would be better after all?

I am curious whether our government will enforce the deadline so strictly. A house is a complex project involving various trades. At the current planning stage, I can only change this with great financial losses - which I will not do. I have been signing contracts since October 2022, and they do not include a heat pump… but the chimney is already there with the shell builder. I have now designed the photovoltaic system so that it supports me with the ventilation system to meet the requirements according to the Building Energy Act. The energy calculation has been done and paid for. Besides, after 1.5 years of planning and the third redesign (KfW 55, KfW 40, and now the Building Energy Act), I have no more desire to continue. I had indeed planned KfW subsidies: 25 kWp photovoltaic, 12 kWh battery for me and the tenant of the granny flat, and a heat pump. Because of Mr. Habeck, I have now ended up with gas and a smaller house (because my budget in € is unfortunately limited). All right - I am good and flexible enough to redesign this. But now it’s over - despite declining construction activity, I will not be the only one, as you can see even with the thread creator. I hope for the best and look forward to the next federal election.

Until the federal election in 2025, I would definitely assume a hard line. Especially since the end of gas heating was also planned for 2025 under the CDU. No one will make a big fuss over one year. And I wouldn’t bet on a CDU government reversing it. Because SPD or the Greens will almost inevitably be involved. The FDP is a done deal.

So you are taking a considerable risk. Even a 2-month delay in the start of construction will make it impossible to succeed.

Not to be misunderstood. I got a gas heating system installed in my new building in December 2022, so I am anything but completely convinced by the heat pump. Not because I consider it technically absurd, but because we are not yet ready for mass installation... But that doesn’t help you at all if, as I said, the installer tells you on 1/2/2024: "I risk my license if I install/commission it now. Sorry."
