Actually quite simple. Goal not reached – reward is lost.
==> Loan must be repaid. VE is to be discussed.

This would not be the first case where KfW wants their funds back. Whether there is a case-by-case solution in consultation with the KfW must be discussed on a case-by-case basis (e.g. fallback to non-QNG = partial repayment).

And I can just sell the place directly then? That can't be the solution. Fallback to non-QNG can't be possible since there is nothing below QNG Plus?

Why do you want to pass the buck to someone else? You order a house with the framework data XY. If this house is not delivered, you have a claim for defect rectification. You have to enforce that. I would now know in every normal constellation, where a single-family house is properly planned and the implementation is professionally (externally) supervised, where the goals could not be achieved. If you change things during the construction phase, YOU also have to bear the consequences - not others. The issue is usually not an issue at all. It becomes more interesting with KfW and professional developers who find after applying for KfW funds that the planning needs to be changed (too few small apartments or vice versa, etc.).

Who do you want to hold liable, does the company guaranteed QNG appear in the house contract, or do you just have an extra charge for it.
If you complain about that, there is surely a customer request from you that is to blame.
