I have informed the general contractor of the situation accordingly. The reflexive response is the reference to Corona and the bad weather situation due to snow in February.
A bad weather situation according to VOB (they have a construction contract building code) did not exist this winter. When I looked at the average temperatures, frost and ice days from 1980 to 2010 of the nearest weather station according to DWD and compared them with this winter’s records, we are exactly at the average. => Argument refuted
I would also not accept the Corona reference. We signed only in mid-June 2020 after the first lockdown and all the initial business closures due to quarantine. Corona risks were known to the general contractor. There were no material shortages at our construction site, at least none communicated to us. Before it really started, everything was already installed. => Argument at least not legally binding from my layman’s point of view.
Delays largely caused, from our point of view, by:
[*] Bricklayer worked alone for almost three months. He looked at every brick intensively from all 6 sides for the amusement of the building area before installation. [*] Sawing work of the ceilings due to wrong installation and missing control by the general contractor’s site manager. Discovered end of June. Since then correction work, screed and vacation time of the staircase builder. [*] Delay of screed layer (tightly scheduled) due to the above-mentioned correction work [*] Staircase builder not closely supervised by the general contractor. He’s been dawdling forever and holding everything else up. However, this also results from the redesign due to sawing work.
Also, I pointed out the considerable energy costs for the construction dryers running for weeks to catch up on the delays with the screed. I also want a proportional cost contribution for that. Including the screed heating program, we consumed 6000 kWh.
He will get back to me next week when his responsible site manager returns from vacation next week. So far, we have always found a deal sufficient for both sides. It just annoys me when cheap excuses are put forward and someone doesn’t admit to their mistakes. Based on our previous experience with the general contractor, I just hope that I got upset for nothing again and the research regarding bad weather was premature.
