You have to think further – why does he make such a statement? Because it is quite clear that he can no longer realize your project at the fixed price. That obviously applies equally to all his other projects in the pipeline. And there may / probably are many in the same situation as you – big increases in costs are not manageable, the loans already signed, etc. What remains of that in 6 months, no one can say.

Incredible what is happening here with you, I am truly at a loss for words. There were absolute planning amateurs at work + an ultra-bold construction contractor.

That is of course true. The other builders or clients will be no better off. But I simply find the way they are now grumpy and uncooperative inappropriate.

I just received the following feedback from our energy consultant:


“this uncertainty often arises because the requirements are usually based on the BayBo and not on the KfW criteria. The BayBo requirements are not applicable for KfW funding eligibility, only possibly relevant for building permits in Bavaria.

The KfW has its own nationwide valid requirements:

1. It must be an enclosed area (only one door to the apartment)

2. A cooking facility must be available (at least the connections for water and wastewater must be installed in the wall)

3. A wet cell with toilet and shower must be present

4. A living and sleeping facility must be available

There are no requirements regarding room height, window areas, parking spaces, or the like.

You may also use all rooms yourself and simultaneously.”

This is the KfW's definition - word for word. And you are not building rooms intended for permanent residential purposes in your granny flat. You are building official cellar rooms. You are not allowed to live permanently in the basement or run a household there.

But if you do not comply with the minimum standards according to BayBO, it is not a living room and thus not a dwelling for permanent living.

What does the person who actually drew the plan say? They are responsible for ensuring that all requirements are met, especially in the case of a detached house.
