In paragraph 2 section 4 sentence 1 of the Niedersächsische Bauordnung, a full story is only considered as such if the clear height is 2.20m or more over 2/3 of the area. This allows for some quite amusing constructions in our development area (less so for the neighbors), as no eave height is specified. Thus, in the countryside a 9m high building is erected that looks like it has three floors, although only one story is permitted (full story, recessed story with <2/3 of the full story's area, non-full story under 2.2m on top). Or the latest highlight at the entrance of the development is a 4-story apartment building in an area with 2 full stories (story <2.2m for garages and building services and bicycles, full story, full story, recessed story). With a height just at the allowed 12m. And it looks like a block with 4 floors. What I mean to say is that German building law is quite generous when there is no eave height but only a roof ridge height as a limit.
