And don't forget, you are in 100th place, even if you overtake 60, you are not in the top 25....

In our community, there is a similar situation, 25 plots and over 1000 applicants from everywhere, you can't please anyone. I find it rather unfair when the plots are sold to developers

Then I'll shorten it for you so you can come to terms with it faster.

Summary:
The parties are disputing the allocation of a building plot within the framework of the local resident model...

Result:
- The lawsuit is dismissed.
- The plaintiffs are jointly liable for the costs of the proceedings.

Google "Einheimischen Modell Klage" first result.

That should be all there is to say about it.

You have no legal claim to purchase land in Gemeinde XY. So what damage is supposed to occur to you? Totally ridiculous. You're just pissed because with spot 100 out of 25 you definitely won't get a chance. Accept it. The demand for land has been huge for years; the fact that there are still subsidized plots at all is a miracle.

What do you think a lawsuit will achieve? The chance is basically zero, and in the worst case, the municipality won't sell any land because a legal proceeding is pending. Even if you eventually win, you might want to consider what your neighbors will think of you and whether your kids will be invited to birthdays.
Send your child to a language school if it's that important to you. They exist everywhere.
Otherwise, there are plots and existing buildings in/near the desired municipality on the private market.

There are people. Oh wow.

That would be news to me. Actually, the local jurisprudence here in Germany is clear on that.

And why have they not been completed? Whose bread I eat...

Instead, the Federal Ministry of Construction said in March 2017:

This has been reflected in § 11 of the Building Code.

Well, see the Building Code amendment above from 2017...

Quite simply. It is supposed to enable the children of the current population of the city/municipality not to be displaced from their homeland.

The city or the village has decided for itself that they prefer to have locals living there. I find that legitimate and understandable.

Instead of making a big fuss here, you should look elsewhere.

For years with us, allocation was done according to a list that was kept at the property office....whoever signed up first got something first....I also found that fairer than it is now, because everyone who signed up would eventually get something.

I also find it unfair how it is now for the following reasons:

- why do you get a building plot sooner if you already have 2 children, from my way of thinking I would first want to create space for the children and then have them
- if my municipality does not designate building plots for the next 5 years, but the town 1 km away does, I still don’t get a building plot....I am not considered a local due to that 1 km difference and am treated the same as anyone else who just moves in, if locals are preferred, why then not also include people who have lived 1 km away for 20 years?
- it gets even worse when there are salary points.....points for earning little....the building plot then costs 400 euros per square meter....
Who then builds there? No money, gets a building plot, and what does he build with then?

All nonsense.
I am also in favor of a list or lottery.
