The municipality can apparently also allow residential development for this one. Just read paragraph 35 section 6.

Exceptions confirm the exceptions... That sounds positive again. So what exactly is the partially developed? I have now read it as your house and the construction just must not be conspicuous or detrimental to the surroundings. Maybe you are lucky and are not allowed to pave your yard anyway, but have to gravel it. Then these costs will only have minimal impact ;)

I also cannot imagine that a new building plot is sold for a single-family house which is supposed to fit in with the surroundings and in the end is not like that. The realtor will never sell anything again if that comes out.

Oh yes, he will get away with it 99.9%... Real estate agents are not expected to know everything. Damage to their reputation is not that important to them either (to put it bluntly: which real estate agent doesn’t have a bad reputation? ;) ).
Did he guarantee the developability to you?
In case of doubt, he will only bring it up at the notary appointment or completely avoid it...

"I thought you wanted to build an orchard / farmstead / ... there."

so, I was just at the property with the realtor and owner. it is the case that the utility lines are already all on the property. one can build 1.5 stories there, as the municipality allows.

a problem now, however, or maybe not. on the street, I will upload a picture, there is a usufruct right. as I understand it, the right is transferred to the new owner of the property so that I am allowed to use this path and not only land there with a helicopter.
does anyone have any knowledge about this?
