German solid house insolvent?

we signed our DM contract a few months ago and paid the first installment, then nothing progressed - now we know why - we received various statements and now know that we were deceived by DM, just a week ago everything was supposedly fine and now we know that the furniture in Gera has already been removed...
Can someone help me get out of my construction contract, if terminated, DM is entitled to 5% recourse of our remaining balance.
Since the insolvency is not yet final, this is also not a reason, is anyone in a similar situation or has an idea?

Actually quite simple but tricky. Remind DM to continue, while setting a realistic deadline. After the deadline expires, set a grace period. Then terminate through a lawyer. You can/should possibly involve the lawyer beforehand. All in all, it takes about 1 1/2 months. Sorry, it cannot be done faster. Please also look at the statement from [Bauherrennotruf]. It is good and worth reading. By the way, I am not a lawyer and this is not legal advice.

Get the bank on board with the termination, many building owners have forgotten this and cannot access the financed money to continue building.
