1) Return of the original financing confirmation from DM
(...and then my legitimate question, what if DM can no longer return it?)

then option no.

2) After proof from you that the termination at DM is legally valid, Ing-Diba releases the funds on its own.

Still regarding this:
- Have this given to you in writing
- Have Ing-Diba give you in writing that in case of termination at DM, the construction project will continue to be financed through Ing-Diba if all the conditions are met (it should say WE GUARANTEE... or WE CONFIRM...)

Well, and this is exactly where our problem begins, so far so good, exactly what ING-DiBa promised us, requested 5 documents for it, we sent everything – and have not heard anything for weeks!! And now?? What good is this statement to us if we still have not received a single cent? And no one returns our calls, no one explains why, etc.? What else are we supposed to do?
