German solid house insolvent?

The question is how far along your construction project is? We are at about 82% payment; screed, electrical work, heating, drywall, and exterior plaster are still missing. We are waiting until DM goes down the drain!!! The way DM is currently behaving, it can't be much longer! Payments will not be made until further notice. I am already having offers sent to me from craft companies and continue building without DM. We will not cancel the contract because they would be happy then, since they could still collect money.

Construction is scheduled to start at the beginning of March. I have also just spoken with dm-Haus. The man took my concerns very seriously and promised me to start on time and build very good quality. He also told me that the company is doing well.

then they only have 18% left?? How do they want to finish their house with that???????? Screed, electrical work, heating, drywall, and exterior plaster?????

We have also concluded a construction contract with DM. Construction is supposed to start in March. Does anyone have news regarding the insolvency proceedings? There is certainly nothing to be read yet under [Insolvenzbekanntmachungen]. Allegedly, the insolvency application was rejected, but DM has not sent us the corresponding decision.

yes, I spoke with dm-Haus today. everything is supposed to be fine, but now I heard from my dm salesperson that dm-Haus GmbH will separate from its sellers. for this purpose, a dm-Haus AG was founded by the former managing director Rudolph, with headquarters in Gera like dm GmbH. what this means for my contract is unclear. just so much..... the former seller of dm wants me to urgently transfer the contract to dm-Haus AG. his argument is that then my construction project would be handled regionally.

should I do that????????????

to be honest, I am afraid of that. it looks like a shady deal and well, not serious.
Please help me!!!!!!!!!!!!!!!!!!!!!!!!

I would wait at least until Friday. The court decision regarding the outstanding 1.1 million is supposed to be made then. Maybe everything will be over by then.

I would be cautious with transfers; I would have that examined carefully. Without legal assistance, this is a very difficult question. My gut feeling says no. Check whether a special termination right might apply in case of the transfer.

I think a termination of the business operation will eventually be unavoidable given the currently quite widespread sentiments. Building a house is also a matter of trust. In the end, the courts will have to decide on the question of liability.
