WARNING!

The right of choice according to § 103 does not mean that the insolvency administrator waives any claims, but only means that she no longer intends to fulfill the contract.
Claims that the insolvency administrator asserts against you remain unaffected by this.
The insolvency administrator would have to waive in writing all outstanding claims in this context; only then would the claims against the builders be extinguished.

So please do not be mistaken that the payment requests from the
insolvency administrator are thereby settled.

Here again is the excerpt from the Insolvency Code.

§ 103 Right of choice of the insolvency administrator

(1) If a reciprocal contract has not been fulfilled either fully or partially by the debtor and the other party at the time of the opening of insolvency proceedings, the insolvency administrator may perform the contract instead of the debtor and demand performance from the other party.
(2) If the administrator refuses to perform, the other party may only assert a claim for non-performance as an insolvency creditor. If the other party requests the administrator to exercise his right of choice, the administrator must immediately declare whether he wishes to demand performance. If he fails to do so, he may not insist on performance.
