Pool is real luxury in my eyes. We would like to have one, yes. But first everything else should be finished. And if a pool, then rather about 4.5x9 meters. For that you basically don't need a permit.

I also see it that way, that the municipality has stirred up a huge mess with the extra plan for MI3 and all the other special regulations around it, but I don’t see that it would be easily challengeable. Such things usually evolve historically. We also have a separate development plan for our property because we were allowed to build first in the outer area back then. Over time, neighbors gradually joined until the municipality finally wrote a supplementary statute for the entire street. However, the individual decisions have remained as they were. The deviations are mostly marginal, as I can see here so far. But the city of Lorsch makes it very clear in several places in the plan that a building line applies to Nibelungenstraße and recesses are not allowed. Unfortunately, it does not define what recesses are – which in my opinion would be the only point of attack.

The question is whether any kind of alternative construction method justifies a legal dispute. I see here a rather simple gable-sided building of about 9m x 12m. To the right a carport and parking space on the left side of the plan. Quickly sketched without claim to originality:

A legal dispute is out of the question for us. With the current interest rate situation, unfortunately, we don’t have time for a legal dispute. As I said, right now we are rather wondering if there are solid reasons to fire the architect?

A pool counts as an "ancillary structure." Therefore, you need to check if, and if so, what the development plan says about "ancillary structures outside the buildable plot area."
Our pool is also outside the building line, but our development plan explicitly states that ancillary structures (except garages and carports) are also permitted outside.

Well, one could argue that the garage in the design is not approvable. That is quite a blunder. If you insist that relocating it with this floor plan is unacceptable and really push hard, I could imagine that you might agree on a "compensation" amount and get out of here. On the other hand, like any market participant, the architect has the right to make corrections. Maybe the argument of the distance from the building site and the significant loss of trust will help more. If push comes to shove, you can also threaten to publish the "shame." Well, but it probably won't go without losses. What exactly did you sign?
