I don't quite understand the problem right now. If that is decided for you and you are already familiar with it in practice, then just build it that way. Then the critical questions from the forum can't shake that position at all. Or, perhaps you are unconsciously not so sure what you really want, which is also visible by the fact that the architect's design actually implements all wishes, but leaves you dissatisfied.

Although we don't live on a slope, we regularly spend holidays in a hillside house and are in the upper apartment there. Now with a child, I find it very impractical that the garden is one floor below. You either have to go up and down all the time or plan accordingly from the start. By the way, the view from the garden is almost the same. If you place a tree right in the view, the extra 2.5 meters in height doesn't really matter. Rather the opposite: you can look past the trunk, the crown is then directly in front of the balcony.
