House on parents' property - inheritance problems?

I find this view strange. Why should the tax office help you save on taxes? You "cheated" the tax office on the real estate transfer tax back then and now you want another discount by pointing out that in the case of inheritance you have to pay so much tax (= are rich)?

He wouldn’t have had to pay real estate transfer tax back then either; direct relatives are exempt from it. At most, the father would have had to tax a profit (if the property was somehow involved in agriculture or in a business asset), or the son would have had to pay gift tax; however, this is unlikely due to the allowances.

At that time, our main concern was actually just to save the division costs (surveying and notary). No one told us that then the house would not belong to me. Also, if I remember correctly, there would have been problems with the setback areas in the case of a division.

That will be difficult enough later anyway if I want to sell everything, because then the buyer would also have to buy the old house. And the area to be developed at the back of the front plot can only be used sensibly if the back plot serves as a garden. However, if the back plot is sold, the district office would use its right of first refusal 90 percent of the time to annex it to the surrounding green area. So this plot would have to be leased to the buyer of the front plot in the long term.

If you had asked a colleague, you could have received several suggestions for solutions right away.
Without real division: At least co-owners in the land register, better ideal division according to WEG.
With real division: Setback area, access path and/or unification building encumbrance

So are there multiple properties?

On what legal basis does this right of first refusal rest?
Besides, you don’t need to worry, because the municipality enters into the negotiated purchase contract.

since the initial situation is clear, there are only 3 possibilities. The house will be gifted to you up to 400000€ no problem, above that gift tax. The house will be sold to you, whereby you can manipulate the cash flow. The house will be transferred into a heritable building right. In all cases, a notary and a division of the property are needed
