House on parents' property - inheritance problems?

Hi, you don’t seem to have fully understood your problem yet: The house you live in belongs to whoever is registered in the land register. No one cares who paid for it. If your father is listed there, you have the problem in case of inheritance that this house is part of the estate. In other words, you inherit more and then quickly run into issues with the exemption amounts. Regards, Andreas

There are no siblings, of course. Otherwise, I certainly wouldn’t have done it that way. I will make further inquiries about it. If I remember correctly, we were even at a tax consultant back then...

Maybe [Zeugen Jehovas] are also mentioned in the will because they are always so nice and come by.

PS: To avoid offending anyone here. The name of the heir in the will can of course be freely replaced.

Wow, a lot of dangerous half-knowledge going around.

First of all: property tax and inheritance tax are two different things.

Then: you were probably treated as the beneficial owner within the meaning of § 39 AO for the purposes of property tax, so your building is a building on someone else’s land. But only economically and only for the purposes of property tax.

Legally, the building belongs to your father – and that counts in the case of inheritance. However: the exemptions are quite high, maybe you’re lucky and stay below them. Then nothing will be due anyway.
