We just had contact with an architect who explained the issue with the building encumbrance as follows:
The municipality is the owner of the plots and can therefore register a building encumbrance on the plots. The building encumbrance is then transferred to the actual buyers upon resale, and voila, the municipality no longer has any legal problems regarding the shared roof shape.

Yes, sure, that's how it works BUT what does the municipality do if all the plots per row are sold before the first building application is submitted and the roof shape etc. is "fixed"? That would be the interesting question... or how is the process of land purchase and house construction supposed to proceed here?
