So... here is the response from the building authority:

Good day Mr. xxx,

within the framework of the development plan, certain planning and building regulations have been set, thus creating a framework that still gives prospective builders sufficient room for individual solutions.

Different wall and building heights are permissible up to the specified maximum values. There is no obligation to have a basement. A uniform roof shape for groups of houses is secured by a building burden; whereby the first building application submitted here determines the roof shape.

If we know the 3 or 4 applicants for the row houses, we will try to coordinate their building projects – also in the interest of cost-effective construction.

We are now a bit unsettled. The motto "First come, first served" indeed seems to be applied.

If the building area were not currently so without alternative, we would have long since lost interest...

Now the race begins..... The first one can stake a claim here - so quickly create and submit the project (and hope to be the first). That would be too exhausting for me and the outcome probably uncertain.

That means a building encumbrance with a specified roof shape will later be added to already sold plots and may, in some cases, make some "almost-finished plans" of those who narrowly lose the race completely obsolete? Welcome to Schildburg.

This is indeed a foolish act. I am curious about the legal basis in the reasoning for rejecting a building application that complies with the development plan. Whether the development plan will withstand the expected legal pressure? I doubt it.
