We are already at a height of over 14m with the existing building. Are we then automatically building class 5? Yes or no?

The building has approximate external dimensions of 40m x 17m. Currently, there is a staircase roughly in the middle of the building. If, for example, 6 apartments per floor were planned there, would 2 staircases be needed? (I am not concerned here whether this can be sensibly divided, but purely about the regulations.) The consultant said that 2 staircases would be mandatory because of escape options. However, there is no connection from staircase A to staircase B. Not even in newly built houses. That is why the purpose of the regulation is not entirely clear to me. What does it depend on? Anyone have an idea?

With two staircases, it's mathematically only 3 apartments per staircase, and then it counts as just 1 house. Or because of the 35m rule. Whatever.
There must be some reason for studying architecture.

In a building measuring 40 x 17 m that may be true; as far as I know, 30 m is the maximum distance from the farthest room corner to the stairwell. Additionally, there are staircase width regulations related to the occupant load: those fleeing should not bottleneck. But that is a problem for much taller buildings. Normally there is – namely the floors that lie between both stairwells.

There are different regulations depending on the federal state. It is also stated in the respective building codes (e.g. in your case §§ 33 and 35 Saxon Building Code). Ultimately, however, only the architect in consultation with the fire department can tell you. For building class 5, for example, the walls of the staircases must also be constructed as firewalls. The second escape route can also be possible via fire department rescue equipment depending on the design of the building. But as I said, you need the local specialists for that. By the way, for the rental suitability, an elevator should also be installed given the building height.

Thanks already for the information. We would like to examine whether preserving parts of the existing building makes sense. For this purpose, all ceilings, the staircase, and the roof would be torn out. Practically, only the exterior walls would remain standing. These are 60 to 65 cm thick, solid, and made of bricks. For apartments, 2 staircases including elevators would then be planned, and possibly an additional floor. The consultant said it is not worthwhile. He is probably not entirely wrong, since the rooms, among other things, are incredibly high. For example, the ground floor has a floor height of 4.20 m.

On the other hand, it may be possible to spread the work over several years and initially rent parts only to commercial businesses. This would allow the costs to be recorded as a loss carryforward in the current business activity. When the walls including fire protection requirements are eventually finished, a conversion could be planned, renewing the interior layout and adapting the outdoor facilities.

For completeness, here are the floor area ratio: 0.4 and the plot ratio: 1.2. The consultant’s plan foresaw building 75 residential units on approx. 5500 m². Unfortunately, I don’t have the exact m² numbers here right now. He calculated it precisely.

He assumes €1,250 per m². With 75 residential units × 100 m² × €1,250 that would be €9.375 million. Although the figure looks unaffordable for us, I still consider the €1,250 a joke. Sure, with so many apartments there are some synergies, but that much? It makes me very skeptical.

Then it makes no sense if it is so far beyond the financial capacity of the family investors. Who is supposed to pay for it, or what is your role according to his concept?
